SAN FRANCISCO (KCBS) -- Charges were dropped against one of two San Francisco men charged in the so-called Bakers Dozen beating case. The charges against the other suspect were reduced.
Brian Dwyer and Richard Aicardi, 20, cried and hugged each other when the judge dropped the charges against Dwyer and reduced the charges against Aicardi to one count of misdemeanor assault.
At the close of a three-day preliminary hearing, Judge Kathleen Kelly said she was "very, very troubled" by and "very sorry for" the attack on Evan Gogel and William Bailey, but added that there was not sufficient evidence to hold Aicardi and Dwyer accountable.
Both were facing felony assault and battery charges from a New Year's Eve brawl last year between a group of Sacred Heart Cathedral Preparatory high school graduates and the Yale singing group, the Bakers Dozen, outside a house party in the Richmond District.
The incident made national headlines when the young men were accused of starting the fight after the Yale singers sang “The Star Spangled Banner.” Conservative talk show hosts immediately pounced on the story and painted the local boys as anti-American.
Civil suits are still pending against Dwyer and Aicardi.
