SAN FRANCISCO (KCBS) -- San Francisco will be in Superior Court tomorrow defending itself against a lawsuit over the city's new ban on tobacco sales at pharmacies.
Walgreen’s says that it’s being discriminated against because it was told by San Francisco that it cannot buy cigarettes, while other stores with pharmacies, such as Safeway, still can.

”It’s about basic fairness, and this ordinance lacks fairness by singling out drug stores, versus other retailers,” said Walgreen’s Spokesman Michael Polzine.
Walgreen’s attorneys are also prepared to argue that the drug store chain would be prevented from counseling tobacco users about smoking cessation if they have to go elsewhere to buy cigarettes. But San Francisco City Attorney Dennis Herrera says those arguments have no merit.
”Our public health department, and the policy makers have gone into quite a lot of detail regarding the rationale in distinguishing between drug stores and more general stores,” said Herrera.
