OAKLAND, Calif. (KCBS) -- The family of Oscar Grant has hired Oakland litigator John Burris to look into the facts of the case, in which the 22-year-old was fatally shot by a Bay Area Rapid Transit police officer.

At a news conference Sunday, Burris said he'd interviewed witnesses and viewed cell phone video and feels the shooting of the unarmed and prone Grant, reportedly shot in the back, was not an accidental discharge. "It was an intentional act."
The family also announced plans to file a $25 million dollar wrongful death lawsuit against BART police and to seek criminal charges against the unnamed officer.
Grant was killed New Year's Day at the Fruitvale Station in Oakland. He had reportedly been with a group involved in a fight on the San Francisco to Dublin-Pleasanton train just before the fatal shooting.
