SAN JOSE, Calif. (KCBS) -- Prosecutors in San Jose say they will charge three teenagers accused in a Halloween night attack on two kids as adults. The fourth suspect is an adult.
KCBS’ Mike Colgan Reports
An emergency meeting was held in San Jose Thursday in response to a surge in gang violence. The meeting included elected officials, law enforcement officers, community, business and faith leaders.
”The meeting was called because we know that on Halloween night when two young boys were out trick-or-treating, a horrific violent crime was committed,” said Councilwoman Nora Campos. “I’m calling for the community to stand with me, and say that we in the City of San Jose will not tolerate violence.”
San Jose Police Chief Rob Davis says applauded the D.A.’s decision to try the three juveniles arrested in the case as adults.
”I think that based upon the circumstances in this case it’s appropriate,” said David. “Nobody wants to ever have to see a kid go through this, either as a victim, or a suspect, but a very clear message needs to be sent that this type of behavior is not tolerated in our city. We will go to the full prosecution.”
Meanwhile, Police now say the attack may have been prompted by the boys’ footware.
KCBS’ Matt Bigler Reports
Eduardo Cristobal, an 18-year-old Milpitas resident, was taken into custody today, and three juveniles, a 15-year-old boy and two 16-year-old boys were arrested earlier this week. Police are not releasing the names of the juveniles.
Police said the attacks were gang-related, although the victims are not affiliated with a gang. The trick-or-treaters were however wearing Nike Cortez shoes.
”I wouldn’t allow my child to wear that shoe,” said Mario Maciel, who manages gang intervention for San Jose.
He says that the Cortez, especially in red or blue, is on the long list of clothing that gangs use to identify themselves and their enemies.
”To them, that’s enough sometimes to elicit violence,” said Maciel. “It’s so unfortunate.”
The boys were attacked shortly after 10 p.m. Saturday while they were trick-or-treating in the 2000 block of Story Road, police said. The 12-year-old boy who was shot remains in critical condition, and his friend who was stabbed is recovering, according to police.
