HAYWARD, Calif. (KCBS) -- Residents of a quiet Hayward neighborhood gathered Friday night to remember a man who was killed after his dog sniffed the leg of a gunman.
The group had hoped the Thanksgiving holiday would not pass without the arrest of the gunman who took the life of Thomas Cunningham.
An American flag waves in the Cunningham front yard over an idle barbecue. The 38-year-old was shot to death just two blocks away while he and his daughter Chelsea, 13, went out for ice cream.

Police believe Cunningham’s dog—walking off leash—sniffed at the shooter moments prior to the gun shots that took his life, a shooting neighbor Chuck Rogers said was “totally uncalled for.”
“If a person was scared of an animal like that, they could have shot the animal instead of the person,” he said.
Rogers and other neighbors said Cunningham’s dogs are not aggressive.
Hayward police are still searching for a slightly built black male in his early 20's who was wearing baggy blue jeans and a black hooded sweat shirt.
